Terms & Conditions

Important Notice

These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the “CPA”). Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit, or avoid any right or obligation, as the case may be, created for either you or Wilco Naumann in terms of the CPA.

These Terms and Conditions contain provisions that appear in similar text and style to this clause and which:

  • may limit the risk or liability of Wilco Naumann or a third party; and/or
  • may create risk or liability for the user; and/or
  • may compel the user to indemnify Wilco Naumann or a third party; and/or
  • serve as an acknowledgement, by the user, of a fact.

Your attention is drawn to these Terms and Conditions because they are important and should be carefully noted. If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask Wilco Naumann to explain it to you before you accept the Terms and Conditions or continue using the Website.

Wilco Naumann permits the use of this Website subject to the Terms and Conditions. By using this Website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally.

Data Processing and Privacy Consent

We utilise advanced artificial intelligence tools, specifically Claude 3.7 Sonnet from Anthropic, to assist in processing your data as part of our services. This AI processes your anonymised data to provide financial analysis and insights. Data anonymisation involves removing personally identifiable information such as names, surnames, account numbers, and ID numbers, while retaining relevant financial data like transaction details, dates, and amounts.

By proceeding with our services, you acknowledge and agree to this data processing method. You understand that this processing is done in compliance with the Protection of Personal Information Act (POPIA) No. 4 of 2013, and Anthropic’s data processing policies, which include strict data security measures and limitations on data use.

Marketing and Communication Consent

By using our services, you are opting in to receive marketing materials, sales offers, and other communications from us. By ticking the relevant box at checkout, you grant us permission to send you marketing emails. You may unsubscribe at any time by clicking the unsubscribe link in any of our emails or by contacting us directly at info@wilconaumann.com.

Returns

Please refer to our Returns Policy for more information about returning products and related refunds, replacements, or credits, which are incorporated by reference into these Terms and Conditions.

Registration and Use of the Website

Only registered users may order Services on the Website. To register as a user, you must provide a unique username and password and provide certain information and personal details to Wilco Naumann.

You agree and warrant that your username and password shall be used for personal use only and shall not be disclosed to any third party. For security purposes, you agree to enter the correct username and password whenever ordering Services, and you acknowledge that Wilco Naumann shall not be liable for any loss or damage arising from your failure to comply with this obligation.

You agree to notify Wilco Naumann immediately upon becoming aware of or reasonably suspecting any unauthorised access to or use of your username and/or password.

By using the Website, you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under 18, you may only use the Website with the supervision of a parent or guardian.

You agree that you will not in any way use any device, software, or other instrument to interfere or attempt to interfere with the proper functioning of the Website. You may not use the Website to distribute material that is defamatory, offensive, contains or amounts to hate speech, or is otherwise unlawful.

Conclusion of Sales and Availability of Services

Registered users may place orders for Services, which Wilco Naumann may accept or reject. Whether or not Wilco Naumann has received payment, acceptance of an order occurs only on delivery of the Services or access being granted to the Services. Wilco Naumann will indicate acceptance of your order by delivering the Services to you or allowing you to access the Services, and only at that point will a sale be concluded.

Prior to delivery or your access to the Services, you may cancel an order at any time provided you do so before receiving notice that the Services are ready for delivery or access.

Placing Services in a wishlist or shopping cart without completing the purchase cycle does not constitute an order for such Services, and as such, Services may be removed from the shopping cart if stock is no longer available or the price has changed.

You acknowledge that availability of all Services on offer is limited and that pricing may change at any time without notice. In the case of Services for which Wilco Naumann has accepted an order, Wilco Naumann will deliver the Services at the price displayed at the time of the order.

Certain Services may not be purchased for resale. Should Wilco Naumann suspect that any such Services are being purchased for resale, it reserves the right to cancel the order.

Payment

We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.

Payment for Services can be made via:

  • Debit card
  • Credit card: where payment is made by credit card, we may require additional information to authorise and/or verify the validity of payment. In such cases, we reserve the right to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts.
  • Direct bank deposit or electronic funds transfer: if you pay via direct bank deposit or EFT, payment must be received within 5 business days of placing your order. Your order will be cancelled if payment is not received within this time.
  • Instant EFT

Once you have selected your payment method, you will be directed to a secure site for payment of the applicable purchase price. You may contact us at info@wilconaumann.com to obtain a full record of your payment.

Delivery of Services

Wilco Naumann offers electronic delivery of Services. Delivery will occur via email or access to a secure online portal, at no additional charge. For more information about delivery, please contact info@wilconaumann.com.

Where Wilco Naumann accepts your order, the Services will be delivered as soon as reasonably possible, but no later than 30 (thirty) days of receipt of your payment. Wilco Naumann will notify you if delivery cannot be made within this period, and you will have the option to receive a full refund if delivery cannot be fulfilled.

Wilco Naumann’s obligation to deliver a Service to you is fulfilled when access to the Service is provided via the agreed electronic delivery method.

Errors

We shall take all reasonable efforts to accurately reflect the description, availability, purchase price, and delivery charges of Services on the Website. However, should there be any errors of whatsoever nature on the Website (which are not due to our gross negligence), we shall not be liable for any loss, claim, or expense relating to a transaction based on any error, save where such liability arises from the gross negligence of Wilco Naumann.

Wilco Naumann shall not be bound by any incorrect information regarding our Services displayed on any third-party website.

Gift Vouchers and Coupons

Gift Vouchers

Wilco Naumann may from time to time make physical or electronic gift vouchers (“Gift Vouchers”) available for purchase. Gift Vouchers purchased by registered users are valid for 3 (three) years after purchase. Gift Vouchers issued by Wilco Naumann as a promotional gift are valid for the period specified on the Gift Voucher.

Gift Vouchers cannot be used to buy other Gift Vouchers or Coupons. They do not accrue interest and are not refundable for cash. Wilco Naumann is not responsible for any harm due to the loss, unauthorised use, or unauthorised distribution of a Gift Voucher.

Coupons

There are two types of Coupons: a Coupon with a fixed amount of discount (“Fixed Coupon”), and a Coupon with a discount calculated as a percentage of the cart value (“Percentage Coupon”). Coupons are issued in Wilco Naumann’s sole discretion and may be corrected, cancelled, or rejected at any time.

As a general rule, and unless specified otherwise on the Coupon:

  • each Coupon can only be used once;
  • only one Coupon can be used per order;
  • only one Coupon can be used on the Website per person per promotion/campaign;
  • Percentage Coupons may only be redeemed on purchases with a total cart value of less than R5,000;
  • a Coupon must be used at check-out and cannot be applied to existing orders;
  • the value of the Coupon will be set off against the value of your shopping basket, and any balance remaining will be charged to your selected payment method.

Coupons cannot be used to buy Gift Vouchers or other Coupons and cannot be exchanged or refunded for cash or credit.

Daily Deals and Other Discounted Services

From time to time, we may offer certain Services at discounted prices as part of a Daily Deal, App Only Deal, or a Bundle Deal. The discounted price will only apply for the period/quantity specified in the relevant Deal. If you purchase a Service in a manner that falls outside of the scope of a Deal, you will pay the then-current listed price.

Daily Deals are available at our discretion, for limited quantities and limited time periods. Only one of each Daily Deal may be purchased per customer. Adding a Daily Deal to your cart without completing payment does not reserve the Deal price or stock. Wilco Naumann will reserve stock for customers in the order in which payment is received.

We do not guarantee a specific saving. The extent of any Daily Deal or discount is at the sole discretion of Wilco Naumann.

We may also offer Bundle Deals comprising multiple Services at a combined price. Any saving resulting from a Bundle Deal applies to the bundle as a whole and may not be applied to individual components.

Online Course Codes

An “Online Course” is a form of distance learning that allows you to develop skills and knowledge on a certain topic, provided by an Online Course provider. An “Online Course Code” is a unique digital code that can be redeemed on the respective websites of certain Online Course providers to access the relevant Online Course.

You will not be able to use Online Course Codes and/or access Online Courses through the Wilco Naumann website directly. You will need to visit the relevant Online Course provider’s website and follow their instructions to redeem your code. You will need an internet connection when using an Online Course Code and/or accessing the Online Course.

Where Wilco Naumann accepts your order, upon receipt of confirmation of payment, your Online Course Code will be sent to your registered email address. Online Course providers limit the number of times any Online Course Code can be applied to prevent fraud. Access to the Online Course may be denied if you have already completed the course or if Wilco Naumann has cancelled the order.

Illegal Use of Online Course Codes: By purchasing any Online Course Code and/or accessing any Online Course, you acknowledge that you may not modify, reproduce, transmit, publish, participate in the transfer or sale of, create derivative works from, distribute, or in any way exploit any Online Course or any part thereof, in violation of the relevant Online Course provider’s terms and conditions.

Third Party Sellers

Wilco Naumann will indicate on relevant product pages and checkout pages when Goods or Services are offered for sale by a Third Party Seller (as opposed to Wilco Naumann itself). The sale formed on acceptance of your order for Goods sold by a Third Party Seller is between you and that Third Party Seller, and not between you and Wilco Naumann.

The Third Party Seller is solely responsible for fulfilling delivery of the Goods and is also responsible for managing and processing any returns of Goods. However, because Wilco Naumann wants registered users to have a consistent experience, Wilco Naumann will manage any returns process on the Third Party Seller’s behalf.

Not all Third Party Sellers are registered VAT (Value-Added Tax) vendors. Only Third Party Sellers who are registered VAT vendors will be able to provide tax invoices.

POPIA: Protection of Personal Information

We fully comply with the Protection of Personal Information Act (POPIA) No. 4 of 2013, which governs the processing of personal information in South Africa. Our approach to personal information is guided by the following eight conditions:

  • Accountability: We are responsible for ensuring that personal information is processed in accordance with the Act.
  • Processing Limitation: Personal information will only be processed lawfully, with your consent, and for the purpose disclosed to you.
  • Purpose Specification: Data will not be retained longer than necessary for the purpose for which it was collected.
  • Further Processing Limitation: Any further processing must be compatible with the initial purpose.
  • Information Quality: We ensure that your information is accurate, complete, and up-to-date.
  • Openness: We inform you about how your data is processed, as outlined in this section.
  • Security Safeguards: We implement appropriate technical and organisational measures to secure your data against unauthorised access, loss, or destruction.
  • Data Subject Participation: You have the right to request access to, correction of, or deletion of your personal information held by us.

PAIA: Promotion of Access to Information

In terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA), Naumann Finance (Pty) Ltd is required to compile and make available a manual describing the records held and how they may be accessed. FAIS Act Disclosure

Naumann Finance (Pty) Ltd operates under the Financial Advisory and Intermediary Services Act (FAIS Act) in association with Van Rooyen and Raath Financial Advisors (Pty) Ltd (FSP Licence No. 33603). All financial advisory and intermediary services are rendered in compliance with the FAIS Act and the relevant codes of conduct prescribed thereunder.

Compliance Framework

Our business operations comply with all applicable South African legislation and regulatory frameworks, including but not limited to: the Financial Intelligence Centre Act (FICA), the Financial Sector Regulation Act (FSRA), the National Credit Act (NCA), the Consumer Protection Act (CPA), and the Electronic Communications and Transactions Act (ECT Act).

Changes to These Terms and Conditions

Wilco Naumann may, in its sole discretion, change any of these Terms and Conditions at any time. It is your responsibility to regularly check these Terms and Conditions to ensure that you are satisfied with any changes.

Any such change will only apply to your use of this Website after the change is displayed on the Website. If you continue to use the Website after such amended Terms and Conditions have been displayed on the Website, you are deemed to have accepted those changes.

Electronic Communications

When you visit the Website or send emails to us, you consent to receiving communications from us or any of our divisions, affiliates, or partners electronically, including via email or via notices posted on the Website. This satisfies any legal requirement that communications be in writing.

Ownership and Copyright

The contents of the Website, including any material, information, data, software, icons, text, graphics, layouts, images, sound clips, advertisements, and similar items (“Website Content”) are protected by law, including but not limited to copyright law. All Website Content is the property of Wilco Naumann.

You will not acquire any right, title, or interest in or to the Website or the Website Content. Any use, distribution, or reproduction of the Website Content is prohibited unless expressly authorised in terms of these Terms and Conditions or otherwise provided for in law.

Intellectual Property

All content, reports, and recommendations generated through our Services, including those assisted by Claude 3.7 Sonnet (Anthropic AI), remain the intellectual property of Wilco Naumann. By using our Services, you are granted a non-exclusive, personal, non-transferable licence to use such content for your personal or internal business purposes only.

User-generated content (e.g. ratings or reviews) submitted to the Website may be used by Wilco Naumann for promotional purposes, subject to applicable law and the provisions set out in our Privacy Statement.

Disclaimer

The use of the Website is entirely at your own risk and you assume full responsibility for any risk or loss resulting from use of the Website or reliance on any information on it. Whilst Wilco Naumann takes reasonable measures to ensure that the content of the Website is accurate and complete, Wilco Naumann makes no representations or warranties, whether express or implied, as to the quality, timeliness, operation, integrity, availability, or fitness for purpose of the Website or any of its content.

Limitation of Liability

Cancellation Policy

You may cancel an order for Services prior to delivery or access, provided you notify us in writing via email to info@wilconaumann.com before receiving notice that the Services are ready for delivery or access. Wilco Naumann will refund any payment already made in respect of a cancelled order within 30 (thirty) days.

Wilco Naumann reserves the right to cancel any order at its discretion, including due to errors, unavailability of Services, or suspected fraudulent activity, and will provide you with a full refund in such circumstances.

Availability and Termination

We will use reasonable endeavours to maintain the availability of the Website, except during scheduled maintenance periods, and are entitled to discontinue providing the Website or any part thereof without notice.

Wilco Naumann may, in its sole discretion, terminate, suspend, and modify this Website with or without notice to you. You agree that Wilco Naumann will not be liable to you in the event that it chooses to suspend, modify, or terminate the Website.

If you fail to comply with your obligations under these Terms and Conditions, including any incident involving payment of the price of an order, this may (in addition to any other rights and remedies available at law or under these Terms and Conditions) result in the suspension or termination of your access to the Website.

Wilco Naumann is entitled to terminate your access to the Website for purposes of preventing suspected fraud and/or where it suspects you are abusing the Website or have created multiple accounts to abuse promotions or services.

Governing Law and Jurisdiction

These Terms and Conditions and our relationship and/or any dispute arising from or in connection with these Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts.

In the event of any dispute arising between you and Wilco Naumann, you hereby consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa, Western Cape Division, notwithstanding that the quantum in the action or proceedings may otherwise fall below the monetary jurisdiction of that court. Nothing in this clause limits your right to approach any court, tribunal, or forum of competent jurisdiction in terms of the Consumer Protection Act.

Complaints

We are a participant under the Consumer Goods and Services Industry Code and are bound by it. An electronic copy of this Code is available at www.cgso.org.za.

If we do not resolve your complaint within 15 (fifteen) business days of you having notified us of it, you are entitled to approach the Consumer Goods and Services Ombud (CGSO) with your complaint. The CGSO can be contacted on 087 362 8000 or at complaints@cgso.org.za.

You may not cede, assign, or otherwise transfer your rights and obligations in terms of these Terms and Conditions to any third party without the prior written consent of Wilco Naumann.

Any failure on the part of you or Wilco Naumann to enforce any right in terms hereof shall not constitute a waiver of that right.

If any term or condition contained herein is declared invalid, the remaining terms and conditions will remain in full force and effect.

No variation, addition, deletion, or agreed cancellation of the Terms and Conditions will be of any force or effect unless in writing and accepted by both you and Wilco Naumann.

These Terms and Conditions contain the whole agreement between you and Wilco Naumann and no other warranty or undertaking is valid unless contained in this document.
